1Definitions

means services provided or facilitated by Regal Global through online or offline channels, including property marketing, property enquiries, sales and rental assistance, property consultancy, property investment information, viewing arrangements, client support and other real-estate-related services.

“User”, “you” or “your”

means any person accessing or using the Website or Services, including prospective purchasers, vendors, landlords, tenants, investors, property owners, registered users and agents where applicable.

“Website”

2Acceptance of Terms

By using the Website or Services, you agree that:

1. you are at least eighteen (18) years old or otherwise have the legal capacity required to enter into a binding agreement;

3Nature of the Website

The Website provides property information and facilitates communication between Regal Global, property owners, developers, landlords, prospective buyers, investors and tenants.

Unless expressly stated otherwise in a separate written agreement, information published on the Website does not constitute:

Accordingly, Regal Global does not guarantee that every Property Listing is complete, current or free from errors.

Property information may change without prior notice.

• rental price;
• promotional price;
• availability;
• unit availability;
• floor area;
• land area;
• built-up area;
• tenure;
• development completion date;
• maintenance charges;
• layouts;
• floor plans;
• furniture;
• fixtures and fittings;
• facilities;
• views;
• orientation;
• parking allocations;
• title particulars;
• development specifications;
• developer information;
• rental returns;
• estimated yields; and
• other property particulars.

Users should independently verify any information that is material to their decision before committing to a transaction.

5Prices and Property Availability

Prices displayed on the Website are indicative unless expressly confirmed in writing.

Property prices and rental rates may be changed by a developer, vendor, owner or landlord at any time.

A Property displayed as available on the Website may have been:

• reserved;
• sold;
• rented;
• withdrawn;
• repriced;
• placed under negotiation; or
• otherwise made unavailable

before the Website is updated.

Submission of an enquiry or registration of interest does not reserve a Property.

A Property shall only be considered reserved, purchased or rented when the required documentation, payment and applicable contractual requirements have been properly completed.

6Photographs, Floor Plans and Marketing Materials

Photographs, videos, architectural illustrations, artist impressions, virtual staging, computer-generated images, floor plans, maps and similar materials are provided for general illustration and marketing purposes.

Actual dimensions, finishes, layouts, views, furniture, landscaping, facilities and surrounding developments may differ from materials displayed on the Website.

Images of furnished properties may contain furniture, decorative objects or other items that are not included with the sale or rental of the Property.

Users should verify the actual condition and specifications of a Property during a physical inspection or through appropriate professional due diligence.

7New Development Projects

Information concerning new property developments may originate from developers, authorised marketing materials or other third-party sources.

Development information may be changed by the developer or relevant authorities, including:

• development name;
• completion schedule;
• specifications;
• layouts;
• pricing;
• incentives;
• rebates;
• facilities;

Nothing on the Website constitutes a representation that a developer will complete a development exactly as illustrated or described.

The developer's official sale documentation and the final executed Sale and Purchase Agreement shall prevail in the event of inconsistency.

Regal Global does not warrant the accuracy of ownership information, property condition, existing tenancy information, outstanding charges, title restrictions or other particulars unless expressly verified in writing.

Prospective purchasers and tenants are responsible for conducting appropriate inspections and due diligence.

9Maps, Locations and Nearby Amenities

Maps, travel distances, nearby schools, hospitals, public transportation stations, restaurants, shopping centres, landmarks and other points of interest displayed on the Website may be obtained through third-party mapping or data services.

Distances may be calculated by straight-line distance, estimated driving distance or other automated methods.

Such information is provided for general reference only.

Regal Global does not guarantee:

• walking distances;
• availability of transportation;

12Property Viewings

Property viewings are subject to availability and the permission of the owner, landlord, developer, tenant, building management or other relevant party.

Regal Global does not guarantee that any requested viewing time will be available.

Users attending property viewings must comply with:

• building security requirements;
• management rules;
• safety requirements;
• access restrictions; and
• reasonable instructions issued by Regal Global or the property representative.

13Property Enquiries and Registration of Interest

Where you submit a property enquiry, request a viewing, register your interest or request further information, you authorise Regal Global to contact you in relation to your enquiry.

Depending on the Property concerned, Regal Global may also need to provide relevant information to an authorised developer, property owner, landlord, representative, real estate negotiator or service provider for the purpose of handling your request.

Any processing of personal data will be subject to our Privacy Policy and applicable Malaysian personal data protection requirements.

14User Accounts and Client Portal

Certain features of the Website may require registration or login.

Where an account is provided to you, you are responsible for:

• maintaining the confidentiality of your username and password;
• preventing unauthorised access to your account;
• ensuring information provided under your account is accurate;
• promptly notifying Regal Global if you suspect unauthorised access; and

15Property Owners, Landlords and Listing Submissions

Where the Website permits an owner, landlord, agent or other party to submit a Property for marketing, the person submitting the Property represents and warrants that:

1. they are the lawful owner of the Property or have authority to act for the owner;
2. they have authority to provide the information, photographs and documents submitted;
3. the information provided is accurate to the best of their knowledge;
4. the submission does not infringe the rights of any third party;
5. they have obtained any necessary consents to advertise the Property; and
6. they will promptly notify Regal Global if material information changes.

Regal Global reserves the right to verify, edit, refuse, suspend or remove any submitted listing.

Submitting a Property does not oblige Regal Global to market or accept the Property.

Any formal appointment of Regal Global as estate agent or marketing representative may be subject to a separate written appointment or agency agreement.

16Real Estate Negotiators, Agents and Representatives

Property enquiries may be handled by employees, authorised real estate negotiators, agents or representatives associated with Regal Global.

Users should verify the identity of the person they are dealing with before providing sensitive information or making payments.

Any representation concerning the legal status, ownership, financing, investment return or contractual obligations of a Property should be independently verified where material.

No employee, negotiator or representative has authority to vary these Terms unless expressly authorised by Regal Global in writing.

17Payments and Fraud Prevention

You should exercise caution before transferring money in connection with a property transaction.

Payment instructions may vary depending on the transaction and may legitimately require payment to an authorised developer, stakeholder, solicitor, landlord, vendor, management body, Regal Global or another authorised recipient.

Before making any payment, you should independently verify:

• the recipient's name;
• bank account details;
• purpose of the payment;
• amount payable; and
• authority of the recipient.

Do not rely solely on payment instructions received through WhatsApp, SMS, social media, email or another messaging platform where the payment details have not been independently verified.

Regal Global will not be responsible for loss caused by payments made to fraudulent, impersonated or unauthorised accounts where such loss was not caused by Regal Global's breach of its legal obligations.

Users should immediately report any suspicious payment request or suspected impersonation to Regal Global using the official contact information published on the Website.

18Electronic Communications

When you communicate with Regal Global through:

• WhatsApp;
• social media;
• messaging applications;
• live chat; or

8. reproduce or commercially exploit our property database without permission;
9. harvest personal data or contact information;
10. send spam or unsolicited bulk communications using information obtained through the Website;

12. reverse engineer Website software except where expressly permitted by law;
13. infringe intellectual property rights;

23Regal Global Branding

“Regal Global”, its logo, brand elements, graphics and other identifying materials used on the Website may not be copied, reproduced, altered, published or commercially used without our prior written approval.

Use of Regal Global branding in a manner that falsely suggests endorsement, partnership, employment, agency or authorisation is prohibited.

29Limitation of Liability

To the fullest extent permitted by Malaysian law, Regal Global and its directors, officers, employees, representatives and service providers shall not be liable for indirect, incidental, special or consequential loss arising from the use of or inability to use the Website or reliance on Website Content.

This may include loss arising from:

• inaccurate third-party property information;
• changes to Property availability;
• changes in price;
• investment decisions;
• lost opportunity;
• loss of anticipated profit;
• interruption of Website availability;
• unauthorised access resulting from User credential compromise;

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

30Indemnity

To the extent permitted by law, you agree to indemnify Regal Global against reasonable losses, liabilities, claims and expenses arising from:

These Terms of Use shall be governed by and interpreted in accordance with the laws of Malaysia.

Subject to any mandatory rights available to consumers under applicable law, the courts of Malaysia shall have jurisdiction in relation to disputes arising from or connected with these Terms, the Website or Services.

The parties are encouraged to first attempt to resolve any dispute in good faith before commencing formal proceedings.

35Severability

The remaining provisions shall continue in full force and effect.
